Polygon has caused the emission of particulate matter from the Facility into the environment because of its failure to follow its allowable emission limit for opacity at Oven # 3 at the Tennessee Street plant, as measured by a certified observer hired by the company, in accordance with 40 C.F.R. Part 60, Appendix A, Reference Method 9.  The opacity violations were documented at the Facility on August 7-8, 2013, during an opacity test conducted in response to a Section 114 information request.  Oven #3 is representative of the five resin fiberglass production ovens located at the Tennessee Street plant.  To ensure that opacity levels do not exceed enforceable limitations, Polygon completed modifications to each oven stack, while also paying a civil penalty of $25,292.
