On March 26, 2019, after a period of public comment, the Liquidation Court (Superior Court of the State of New Hampshire, Merrimack County, Case Number 03-E-0106) entered an order approving the proposed multi-regional Settlement Agreement between the U.S., on behalf of EPA, the Navy, DOI and NOAA, and the Insurance Commissioner of the State of New Hampshire, in his capacity as the Liquidator of The Home Insurance Company, in connection with the CERCLA liability of its insured, Sharon Steel Corporation, for the Sharon Steel (Farrell Works Disposal Area) Superfund Site; the settlement proceeds will be used to fund cleanup at the Site, located in the vicinity of the City of Farrell, Mercer County, Pennsylvania, which cleanup is estimated at $36 million. The Agreement provides for a total allowed claim of over $27 million, with $16 million of that total allocated to the Site. This is a direct implementation claim for the federal government which arises under the State of New Hampshire?s receivership statute and the Federal Priorities Act.
