On January 27, 2015, Region 10 filed a consent agreement and final order with James Conant to address Clean Water Act violations. Beginning in May 2013 and continuing through August 2013, Respondent violated the CWA Section 404 by discharging an unspecified quantity of dredged and/or fill material for the construction of an approximately 200 linear feet of new levee below the ordinary high water mark of Clear Creek without a Department of the Army CWA Section 404 permit. Respondent agreed to pay a penalty of $7,000.
