03/27/91: SYNOPSIS OF CASE: IN JUNE OF 1990 THE LITTLE ROCK SHCOOL DISTRICT PROVIDED NOTICE TO THE AR DEPARTMENT OF POLLUTION CONTROL & ECOLOGY (ADPC&E) THAT APPROXIMATELY 10,000 SQUARE FEET OF ASBESTOS-CONTAINING FLOOR TILE, 1,200 SQUARE FEET OF OUTSIDE CEMENT ASBESTOS BOARD WOULD BE REMOVE D AT THE PANKY EXCEPTIONAL SCHOOL, A SCHOOL BUILDING WHICH HAD BURNED IN 1988, IN A PLANNED DEMOLITION PROJECT SCHEDULE D TO BEGIN ON JULY 5, 1990. PRIOR TO COMPETION OF THE ASBESTOS REMOVAL, NEIGHBORHOOD RESIDENTS PETITIONED THE CITY COUNCIL OF LITTLE ROCK TO ALLOW THEN TO PURCHASE THE BUILDIN FOR USE AS A COMMUNITY CENTER AND UPON THE COUNCIL'S REQUEST THE SCHOOL DISTRICT STOPPED DEMOLITION ACTIVITIES, INCLUDING ASBESTOS REMOVAL, AT THE SITE. DURING THE SCHOOL DISTRICT' S SUBSEQUENT EFFORTS TO COMPLETE THE ASBESTOS REMOVAL ADPC&E DOCUMENTED SEVERAL VIOLATIONS OF THE CAA & ITS IMPLEMENTING REGULATIONS CONCERNING ASBESTOS. THE SCHOOL DISTRICT ALSO FAILED TO REPORT THE RELEASE OF ASBESTOS IN EXCESS OF ONE POUND IN VIOLATION OF CERCLA.
