Summary

The Hillshire Brands Company operates a commercial bakery located in Traverse City, Michigan. Hillshire uses flavorings at this facility that contain volatile organic compounds (VOC). EPA inspected the facility in November 2013 and confirmed that Hillshire had not ever obtained or applied for a permit from the Air Quality Division of the Michigan Department of Environmental Quality (MDEQ) for its commerical baking operations. EPA issued a Section 114 Request for Information to Hillshire in December 2013, and Hillshire's February 2014 response to the Request included a calculated potential to emit VOC of greater than 40 tons per year, making it subject to Michigan's permitting requirements. This Administrative Consent Order requires Hillshire to submit a complete permit application to MDEQ. As the permitting authority, MDEQ will determine what type of permit is appropriate for this Hillshire facility based on that application.
