## Summary

Carl Buddig and Company is a family-owned and operated facility, and manufactures and markets beef, chicken, turkey, ham and pastrami products.  The South Holland facility contains a refrigerated warehouse facility, which operates two separate anhydrous ammonia refrigeration systems. Anhydrous ammonia is a regulated toxic substance per the CAA RMP regulations. USEPA Region V inspected the facility on September 16, 2010, and found that Buddig had prepared an RMP for its facility, but Buddig had failed to follow its Process Hazard Analysis and Compliance Audit recommended inspection and testing procedures. Buddig also had failed to timely correct deficiencies in its equipment. Buddig has now corrected these deficiencies. On May 23, 2013 USEPA sent Buddig a Pre-Filing Notice Letter stating that it planned to bring an administrative action for the alleged violations and proposed a penalty of $70,000.00. The civil penalty was reduced after consideration of Buddig?s prompt and comprehensive mitigation efforts, the limited duration and environmental impact of the alleged violations, and additional litigation considerations. Buddig worked cooperatively during negotiations with USEPA to resolve this matter. As a result, EPA agreed to mitigate the penalty to $64,000.00. That penalty was paid on November 7, 2014. USEPA and Carl Buddig entered in a Consent Agreement and Final Order (CAFO) on October 28, 2014, Docket No. CAA-05-2015-0004.
