On April 6, 2015, EPA Region 6 issued a Consent Agreement and Final Order (CAFO) under its authority pursuant to the Clean Air Act to Enterprise Products Operating LLC (Enterprise). The CAFO was issued in response to violations of Section 112(r)(7) of the Clean Air Act and 40 CFR Part 68-Chemical Accident Prevention Provisions at the Mont Belvieu plant. The CAFO requires Enterprise to pay an assessed penalty of $378,215 within 30 days of the effective date of the CAFO. Additionally, Enterprise must complete a Supplemental Environmental Project which is estimated at $22,000 to the purchase of emergency response equipment for the local fire department.
