On December 22, 2014, Region 10 issued a unilateral administrative order for removal activities to Alaska Petroleum Distributing, Inc. to address Clean Water Act violations. On December 9, 2014, an Alaska Petroleum Distributing oil tanker truck violated the CWA Section 311(b)(3) during a rollover accident at milepost 48 on Richardson Highway (northeast of Valdez, Alaska), discharging approximately 4,400 gallons of low-sulfur diesel fuel oil into an unnamed creek that flows into Tiekel River and then to the Copper River. The order requires Alaska Petroleum Distributing to take all necessary steps to prevent further migration of discharged petroleum. The order also requires the company to monitor the creek bed on a weekly basis, at the first sign of spring break up of the frozen creek, for evidence of oil sheening. If sheening is encountered, the order requires the company to take appropriate steps as necessary to prevent any downstream migration via sorbent materials or other recovery methods.
