Summary

EPA issued an Administrative Consent Order (ACO) and a Consent Agreement and Final Order (CAFO) to address violations of the Clean Air Act (CAA) to Behr Iron and Metal (Behr), headquartered in Rockford, Illinois. The ACO requires Behr to come into compliance with CAA regulations for the protection of stratospheric ozone at fifteen scrap metal recycling facilities located in Illinois, Wisconsin and Iowa. The CAFO requires the payment of a civil penalty of $30,000 and the completion of a Supplemental Environmental Project (SEP) with a value of at least $75,000. The SEP funds will be used to replace a traditionally-fuelled school bus with a propane-powered bus. Together, these agreement will resolve violations of the CAA for the emission of ozone-depleting substances alleged in a May 9, 2013, Finding of Violation.
