EPA is issuing an Administrative Consent Order (ACO) and a Consent Agreement and Final Order (CAFO) addressing violations of the Clean Air Act (CAA) to Behr Iron and Metal (Behr), headquartered in Rockford, Illinois. The CAFO requires the payment of a civil penalty of $30,000 and the completion of a Supplemental Environmental Project (SEP) with a value of at least $75,000. The SEP funds will be used to replace a traditionally-fuelled school bus with a propane-powered bus. Together, these agreement will resolve violations of the CAA for the emission of ozone-depleting substances alleged in a May 9, 2013, Finding of Violation.
