## Summary

On June 9, 2015, EPA and Shining Ocean, Inc. (Sumner, Washington) filed a consent agreement and final order resolving violations of the hazardous substances reporting requirements of Section 312 of the Emergency Planning and Community Right-to-Know Act (EPCRA).  Shining Ocean failed to submit a Tier II Chemical Inventory report to the State Emergency Response Commission, the Local Emergency Planning Committee, and the local fire department for stored anhydrous ammonia and sulfuric acid for the calendar years 2009 through 2013.  Respondent agreed to pay a penalty of $16,575.  In addition, Shining Ocean will implement a Supplemental Environmental Project (SEP) valued at $87,800 to upgrade the facility's ammonia monitoring system to prevent potential, and rapidly respond to actual, ammonia releases. The SEP includes Next Generation compliance tools by incorporating the use of modern information technology (i.e., smart phones) into the ammonia monitoring system.
