EPA conducted an investigation of respondent's facility on April 19, 2011 and found that they had not included a 2,000 gallon diesel fuel tank on their Emergency and Hazardous Chemical Inventory forms for calendar years 2009 and 2010. This has since been corrected. The respondent agreed to settle the case with USEPA with this ESA and paid a $2,000.00 civil penalty. This payment has been received.
