Respondent owns and operates a plastic pipe manufacturing facility located in Waverly, NY. Stormwater discharges from the facility drain to Cayuta Creek, located within the Chesapeake Bay Watershed. Respondent has coverage under the NYSDEC SPDES Multi-Sector General Permit for Stormwater Discharges Associated with Industrial Activity (MSGP). EPA conducted a Compliance Evaluation Inspection (CEI) at the facility and identified violations of the MSGP, including the following: failure to develop and implement required Stormwater Pollution Prevention Plan (SWPPP) provisions; failure to keep the SWPPP current; failure to conduct annual comprehensive site compliance inspections; failure to conduct quarterly visual monitoring; failure to conduct annual dry weather monitoring; and failure to timely submit a Notice of Intent (NOI) to continue uninterrupted coverage under the current MSGP. The Order requires the facility to comply with the terms and conditions of the MSGP.
