On January 11, 2017, the Massachusetts Federal District Court entered the consent decree settling the United States' claims against Idlewild Acres, LLC, and Peter M. Wild for violations of Section 404 of the Clean Water Act in East Sandwich, Massachusetts. The violations occurred between 2008 and 2010, when Defendants dredged and filled about 14.7 acres of cranberry bogs for use as a tree and shrub nursery. The settlement requires the Defendants to successfully establish or maintain approximately 12.7 acres of freshwater wetlands and ponds, including about 3.8 acres of ponds that were constructed in the wetlands; to place a conservation easement on the entire 14.7 area to permanently prevent uses other than agriculture or nursery operations; and to pay a civil penalty of $22,000 to the United States.
