On February 18, 2015, a Consent Agreement and Final Order (CAFO) was issued to Lamberti USA Inc., Wharton of Hungerford, Texas to resolve RCRA violations discovered during the review of data from Wharton?s hazardous waste activities. The data revealed that on several occasions, Wharton generated quantities of waste that triggered the large quantity generator requirements, and during those periods, Wharton continued to notify and operate as a small quantity generator of hazardous waste. During the data review it was also found that Wharton had failed to make a proper waste determination as well as obtain a permit for storage of hazardous waste. Wharton was identified based on the targeting efforts. The CAFO requires the payment of $230,000 and compliance with RCRA regulations.
