Region 1 settled an administrative penalty action against Ardagh Glass Inc. (AGI) alleging failure to comply with the terms and conditions of the National Pollutant Discharge Elimination System General Permit for Noncontact Cooling Water for the Commonwealth of Massachusetts, failure to comply with the terms and conditions of the Final National Pollutant Discharge Elimination System Multi-Sector General Permit for Stormwater Discharges Associated with Industrial Activity, and discharge of process water containing pollutants on certain days without authorization, in violation of the Clean Water Act. AGI operates a glass manufacturing facility located in Milford, Massachusetts. The settlement requires AGI to pay a civil penalty of $103,440 and to perform three Supplemental Environmental Projects (SEPs) worth approximately $121,700 in total. The SEPs consist of two Projects that will provide for the treatment of stormwater prior to discharge and one Project that will require AGI to purchase equipment and materials for the Milford Fire Department that will reduce runoff to surface waters resulting from firefighting events.
