Chemiplastica, Inc. operates a manufacturing facility at 238 Nonotuck Street in Florence, Massachusetts (?the Facility?). The Facility manufactures thermoset plastics, including urethane formaldehyde and melamine formaldehyde products. The Facility uses formaldehyde solution in its production processes. On May 24, 2012, EPA conducted an inspection of the Facility. During the inspection, EPA identified several deficiencies in the Program Level 3 Prevention Program of the risk management plan, including failure to maintain the facility in compliance with certain recognized and generally accepted good engineering practices, failure to schedule and resolve action items promptly from its process hazard analysis, failure to develop and implement safe work practices for specific operations, failure to correct deficiencies in equipment that were outside acceptable limits, failure to correct problems identified in its 2011 compliance audit, and failure to update its risk management plan within the required five-year time period in violation of Section 112(r) of the CAA, 42 U.S.C. ? 7412(r), and its implementing regulations at 40 C.F.R. Part 68. The ESA requires the respondent to certify it has come into compliance and to pay a monetary penalty of $10,960.
