The USEPA and Excel, Inc., Manteno, Illinois, agreed to the settlement of this action before the filing of a complaint. This is an Expedited Settlement Agreement (ESA) for violations of Section 112(r)(7) of the Clean Air Act. On September 11, 2014, EPA sent a request for information pursuant to Section 114 of the Clean Air Act to Excel to determine compliance with the Risk Management Program (RMP) regulations promulgated pursuant to Section 112(r) of the Act. EPA found that the Respondent had violated the regulations by failing to comply with 40 CFR Part 68.190(b)(1), the requirement to resubmit its RMP at least every five years. The parties agreed to a total penalty amount of $1,200.00
