The Order requires the Respondent to provide EPA with entry and access to two parcels for the purpose of taking a response action in connection with the second operable unit of the Fulton Avenue Superfund Site, which focuses on groundwater contaminated primarily with trichloroethylene in and near the Town of North Hempstead. For the second operable unit remedial investigation, EPA will need to construct a temporary staging area to store investigation-derived waste, equipment and other materials. After a search, EPA identified the Town-owned parcels as suitable for the staging area; EPA did not identify any other suitable locations. The planned groundwater sampling work cannot begin until after access to a staging area is obtained. EPA issued the Order after the Town expressly declined EPA?s requests for access. EPA issued an April 23, 2015, amendment to the Order following an April 8, 2015, conference with the Respondent.
