On April 23, 2015, EPA and the Respondent entered into a Settlement Agreement under CERCLA that requires the Respondent perform the Remedial Design (RD) for Operable Unit One (OU1) at the Maywood Chemical Company Superfund Site in Bergen County, New Jersey. The Respondent owns and currently operates a facility at the Site and is the successor to Maywood Chemical Works, which was an owner when hazardous substances were released at the Site in the past. Under the Settlement Agreement, the Respondent will be required to perform the OU1 RD, estimated to cost $2 million; pay EPA approximately $1.3 million for unreimbursed past costs; and pay all future EPA oversight costs relating to the OU1 RD and an ongoing Remedial Investigation and Feasibility Study for contaminated groundwater.
Amendment issued on September 1, 2021. Settlement Agreement modified by the Explanation of Significant Differences (ESD) for OU1 and Statement of Work. On January 22, 2021, EPA issued an ESD which modified the OU1 ROD to include residences adjacent to the DeSaussure property.
