The consent decree in this matter resolved Clean Air Act violations at fourteen kilns at eleven Portland cement manufacturing facilities located in Alabama, California, Indiana, Iowa, Maryland, New York, Pennsylvania, and Texas. Indiana, Iowa, Maryland, New York, the Pennsylvania Department of Environmental Protection, the Jefferson County Board of Health (in Alabama) and the Bay Area Air Quality Management District (in California) participated as co-plaintiffs in the settlement. The companies agreed to injunctive relief to reduce NOx and SO2; a mitigation project that involved replacing old diesel engines; and a $1.3 million penalty.
