## Summary

Seeking appropriate relief, including penalties and injunctive relief, against the Town for violations of the SDWA, including the Town's failure to provide at least 2-log inactivation treatment for Cryptosporidium using chlorine dioxide, ozone, or UV by October 1, 2014, and the Town's failure to cover or treat the discharge from its uncovered finished water storage facility to the distribution system to achieve inactivation and/or removal of at least 4-log virus, 3-log Giardia lamblia, and 2-log Cryptosporidium.

The Consent Decree establishes a schedule for the Town to comply with the requirements of the Surface Water Treatment Rule and Long Term 2 Enhanced Water Treatment Rule at its public water system. Since the town uses an unfiltered surface water source, it was required to provide treatment to deactivate Cryptosporidium by October 1, 2014. Since the public water system uses uncovered finished water storage facilities, it was required to either cover the facility or treat the water to remove Giardia lamblia, also by October 1, 2014. The CD establishes milestones for the Town to install ground water wells to replace the unfiltered water source of Gooseneck Pond, and a new storage tank, in lieu of covering the Chilson Reservoir, as well as for the upgrade of the existing Baldwin Road filtration plant. In addition, the Town is required to implement a plan to eliminate the treatment issues in the portion of its service area called Eagle Lake-Upper Chilson area.  The Defen
