An Administrative Consent Order (ACO) was signed with Perstorp Polyols, Inc. (Perstorp). The requirements within the ACO will return Perstorp to compliance with the National Emission Standards for Hazardous Air Pollutants (NESHAP) for Miscellaneous Organic Chemical Manufacturing (MON), codified at 40 C.F.R. Part 63, Subpart FFFF and the NESHAP for Synthetic Organic Chemical Manufacturing Industry, codified at 40 C.F.R. Part 63, Subparts F, G, and H.
EPA issued Perstorp a Finding of Violation on March 31, 2014. The FOV alleged that Perstorp violated work practice standards for leak detection and repair, the MON at a certain process unit, parameter exceedances for two catalytic incinerators, and identifying two Group 1 storage vessels. These violations were identified through a November 13, 2013, inspection and subsequent information received on December 6, 2013.
EPA and Perstorp had a 113 conference on May 6, 2014. At the time Perstorp discussed the necessary steps the facility was taking to return to compliance. This ACO will confirm continuous compliance at the Perstorp facility.
