EPA issued an Administrative Consent Order (ACO) and a Consent Agreement and Final Order (CAFO) commencing and concluding an action against POET Biorefining - Marion (POET) for alleged violations of the Clean Air Act. POET operates an ethanol production facility in Marion, Ohio. The ACO and CAFO allege that POET violated volatile organic compound emission limits from its fermentation system during scrubber downtime. The ACO requires POET to modify the facility such that, during scrubber downtime, emissions from the fermentation system are controlled by a thermal oxidizer.
