The Administrative Complaint alleges that ENPRO Services, Inc. improperly manifested PCB waste in violation of TSCA and 40 C.F.R. Part 761 when ENPRO shipped PCBs from 9 Osgood Street, Lawrence, MA 01843 to ENPRO Services of Vermont, Inc.?s facility located at 54 Avenue D, Williston, VT 05495. ENPRO Services of Vermont, Inc. then improperly manifested the same PCBs and exported the PCBs to Canada, distributing the PCBs into commerce where the PCBs contaminated tens of thousands of gallons of potential fuel.
09/03/15: EPA Region 1 filed a consent agreement and final order settling a claim for civil penalties against ENPRO Services, Inc. and ENPRO Services of Vermont, Inc. for allegedly improperly manifesting and improperly disposing and exporting polychlorinated biphenyls (?PCBs?) waste in violation of the Toxic Substances Control Act (?TSCA?), 15 U.S.C. ? 2601 et seq. and 40 C.F.R. Part 761. The settlement calls for the payment of a $46,000 penalty.
