On August 5, 2015, Region 10 filed a consent agreement and final order with Partner's Produce, Inc. (Payette, Idaho) for violations of the hazardous substances release reporting requirements of the the Emergency Planning and Community Right-to-Know Act (EPCRA) and the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA). Partner's Produce, Inc. failed to immediately notify the National Response Center (NRC), state, and local authorities of an approximately 378 pound release of anhydrous ammonia that occurred on February 14, 2014, at its Payette, Idaho facility. Region 10 also settled with Partner's Produce, Inc. for violations of Section 312 of EPCRA for failing to file annual Tier II Hazardous Chemical Inventory Reports for anhydrous ammonia at its Payette facility. EPCRA Section 312 requires companies to file hazardous chemical inventory report forms with the State Emergency Response Commission, the Local Emergency Planning Committee, and the local Fire Department each year by March 1st. The company agreed to pay a penalty of $67,392.
