On July 21, 2015, a Consent Agreement and Final Order (CAFO) entered into by EPA Region III and Eco Product Group LLC (Eco) of Pittsburgh, Pennsylvania was filed with the Regional Hearing Clerk settling alleged violations of the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA). On August 28, 2014, EPA issued a Notice of Noncompliance and Request to Show Cause letter alleging that certain of Eco's SilverSport products did not meet the treated article exemption because the pesticidal claims made in connection with their distribution or sale extended beyond the protection of the products themselves, rendering them unregistered pesticides. Subsequently, Eco developed and implemented a corrective action plan to address the claims, and is certifying in the CAFO that, to the best of its knowledge, all claims, statements and implications made in connection with the distribution or sale of its SilverSport products are in compliance with FIFRA and EPA's PR Notice 2000-1. This action assesses a penalty for Eco's past noncompliance in connection with the impermissible claims it made for its SilverSport products. According to the CAFO, Eco has been assessed, and will pay, a civil penalty in the amount of $8,200 for the alleged violations. Eco is a Pennsylvania company with a principal place of business located at 5700 Corporate Drive in Pittsburgh, Pennsylvania, that sells products under the brand SilverSport .
