EPA sent an email inquiry to the Respondent regarding its apparent failure to submit a TRI Form R report for lead for calendar year 2013 on December 31, 2014. Subsequent to the email inquiry, it was determined the Respondent submitted a late Toxic Release Inventory (TRI) Form R report for lead for calendar year 2013. The report was due July 1, 2014. The Form R report was 183 days late. The failure to submit a TRI Form R report, in a timely manner, constitutes a violation of Section 313 of EPCRA, 42 U.S.C. 11023, and of 40 C.F.R. The proposed penalty was $16,300. The final penalty was $13,855.
