On July 28, 2015, Region 5 filed an Administrative Consent Order (ACO) with Ortek, Inc. of McCook, Illinois. In the ACO, Ortek admits to violations of the Resource Conservation and Recovery Act, as amended, 42 U.S.C. ?6901 et. seq., related to used oil and hazardous waste management. During a 2011 inspection, Ortek was found to have stored used oil in tanks without adequate secondary containment. Additionally, Ortek failed to rebut the presumption that several shipments of used oil it had received were mixed with hazardous waste, and had been utilizing a used oil analysis plan that was not suitable to rebut the presumption. Ortek was also found to have stored hazardous waste in several of its tanks that it had received from an off-site customer. Ortek did not have a permit to store hazardous waste from off-site locations, nor did the tanks in which the waste was stored meet the applicable hazardous waste tank standards. As part of the consent order, Ortek has agreed to install secondary containment around its used oil tanks and to submit a hazardous waste closure plan for review and approval to the Illinois EPA. A Consent Agreement and Final Order to assess a civil penalty is planned for the near future.
