On September 23-25, 2014, EPA conducted a Municipal Separate Storm Sewer System (MS4) Audit of the Town. As a result of the Audit, EPA identified the Town was not complying with the NYSDEC MS4 General Permit. Additional materials were submitted by the Town following the Audit in March 2015; however, the Town remains in noncompliance with certain terms and conditions of the MS4 General Permit (since renewed on May 1, 2015). Violations include but are not limited to: failure to fully implement and update the Stormwater Management Program Plan; failure to map all Town outfalls and conduct a complete outfall reconnaissance inventory (ORI); failure to implement and enforce a program that ensures adequate long-term operation and maintenance of management practices; and failure to implement certain management practices and procedures at Town facilities. An Information Request and Administrative Compliance Order is being issued to order the Town to address remaining noncompliance items pursuant to the NYSDEC MS4 General Permit conditions.
