The Respondents own and operated the construction site located southwest of the intersection of Allen Street and Technology Park Boulevard in the City of Auburn, New York, where construction activities took place between December 2013 and October 2014. EPA inspected the site on May 16, 2014 and identified that the site failed to comply with the terms and conditions of its NYSDEC SPDES Construction General Permit by, among other things, failing to implement and maintain the SWPPP, failing to conduct and document weekly inspections once every seven (7) calendar days, failing to maintain records on-site, and failing to implement corrective actions subsequent to SWPPP inspection notifications. Stormwater discharges from the Site drain to a wetland hydraulically connected to the Owasco Outlet, which flows to the Seneca River. A turbid stormwater discharge from the site to the wetland was observed and documented by EPA at the time of the CEI.
