Respondent stored a PCB contaminated hydraulic machine for more than one year prior to disposal, did not identify the oil as PCB on a manifest, and improperly disposed of the drained machine. The final penalty is $12,050. Amount was reduced for culpability since Respondent had tested the oil prior to disposal and had been given faulty results indicating a low PCB level. Oil was ultimately disposed properly. Hydraulic machine was recycled at a non-TSCA facility.
