This is a Consent Agreement and Final Order (CA/FO) between U.S. EPA and Fertilizer Company of Arizona dba Fertizona (Respondent) for alleged violations of the Federal Insecticide, Fungicide and Rodenticide Act. Alleged violations include failure to keep containment structures liquid-tight, failure to meet design requirements for containment pads, failure to keep required records, failure to identify signs of containment structure damage and make repairs, and distribution and sale of a misbranded pesticide for its facilities in Casa Grande, Buckeye, Fennemore, Yuma and Willcox, Arizona. Respondent consents to the terms of this CA/FO, which include the assessment and payment of an administrative civil penalty of $111,800 and certification that alleged violations have been corrected at the facilities cited in this order.
