In September 2015, Region 1 filed an administrative complaint against Rolf C. Hagen (USA) Corporation (Hagen) of Mansfield, Massachusetts for alleged violations of Section 2(a)(2)(N) (failure to file required reports) of FIFRA and implementing regulations. The complaint alleged that, on numerous occasions, Hagen imported for distribution or sale regulated pesticidal devices that destroy algae and filter waste in ponds and fish tanks without submitting to EPA the required Notice of Arrival of Pesticides and Devices (NOA) forms prior to importation. Through the NOA requirements, an importer reports vital information to EPA regarding the device and its major active ingredients, which allows EPA to make informed decisions about whether the importation will pose unreasonable risks to public health and the environment. Hagen and Region 1 entered a consent agreement under which Hagen will pay a penalty of $141,040 to resolve the claims set forth in the complaint.
