EPA will be issuing an Administrative Consent Order (ACO) and Consent Agreement and Final Order (CAFO) commencing and concluding an action against POET Biorefining - Caro (POET) for alleged violations of the Clean Air Act. The ACO/CAFO alleges that POET violated volatile organic compound and hazardous air pollutant emission limits from its fermentation system during scrubber downtime. The ACO requires POET to perform modifications to allow for emissions from the fermentation system to bypass the scrubber and be controlled by a thermal oxidizer during scrubber downtime. The CAFO requires POET to pay a $130,000 penalty.
