On September 16, 2015, EPA Region III executed an administrative order on consent (AOC) with the Borough of Clarks Summit, resolving CWA violations of Pennsylvania?s Municipal Separate Storm Sewer System (MS4) general permit for small MS4s. During a June 2014 EPA inspection of Clark Summit?s MS4 program, EPA determined that the Borough was violating the Pennsylvania MS4 general permit by failing to maintain a written operations program for its municipal facilities, failing to track the operations of post construction stormwater management facilities within the Borough, and failing to develop a municipal employee stormwater training program. Under the terms of the AOC, Clarks Summit has agreed to develop written programs and additional control measures to correct the permit violations within thirty days of the effective date of the AOC.
In a related administrative consent agreement, Clarks Summit has agreed to pay a $6,000 civil penalty for the MS4 permit violations. That consent agreement is subject to a 40 day public comment period before becoming a final administrative order.
