Summary

On September 28, 2015, Region 5 filed a Consent Agreement and Final Order (?CAFO?) commencing and concluding an action against Actavis, Inc. (?Actavis?). Actavis is a global manufacturer and distributor of pharmaceutical products and is listed on the New York Stock Exchange. Actavis owns and operates a warehouse and distribution facility at 605 Tri-State Parkway, Gurnee, Illinois, that handles smoking cessation products, including off-specification nicotine chewing gum (acute hazardous waste, P075). Actavis allegedly violated the Resource Conservation and Recovery Act (?RCRA?) by (1) failing to make a hazardous waste determination; (2) failing to designate a permitted hazardous waste disposal facility on manifests accompanying shipments of hazardous waste for disposal; (3) failing to submit annual reports to the State of Illinois, and (4) failing to provide hazardous waste training to its employees. Actavis will pay $30,800 to resolve the alleged violations and will comply with the large quantity generator regulations. Robert Smith (LCD) and Kevin Chow resolved the action on behalf of the Agency.
