Summary

M.I.P., Inc. (M.I.P.) owns and operates a plating facility where it conducts, as relevant to this Administrative Consent Order, electroless plating and chromate conversion coating. The facility has one electroless nickel-plating tank and two trivalent chromium tanks that M.I.P. uses for chromate conversion coating and that are subject to the National Emission Standards for Hazardous Air Pollutants: Area Source Standards for Plating and Polishing Operations at 40 C.F.R. Part 63, Subpart WWWWWW (Subpart 6W). During a November 18, 2014, inspection of the facility, M.I.P. was not able to provide the U.S. Environmental Protection Agency with copies of the reports that it was required to submit or prepare under Subpart 6W. EPA is alleging that M.I.P. failed to submit the Initial Notification and Notification of Compliance Status and failed to prepare annual certification of compliance reports required by Subpart 6W for the electroless nickel-plating and the chromate conversion tanks. To come into compliance, M.I.P. will submit to EPA an Initial Notification and Notification of Compliance Status report and prepare annual certifications of compliance reports in accordance with Subpart 6W.
