Violations at the Facility were discovered through a series of inspections, EPA File review and self-reporting documents provided by one of the Defendants. The violations consist primarily of the following: the general provisions of the National Emission Standards for Hazardous Air Pollutants (NESHAP) for Source Categories, 40 C.F.R. Part 63, Subpart A (NESHAP General Provisions), and the NESHAP from Hazardous Waste Combustors, 40 C.F.R. Part 63, Subpart EEE (HWC MACT); the federal hazardous waste regulations set forth in 40 C.F.R. Parts 260 through 273 and 279 governing hazardous waste identification, classification, generation, management and disposal, and the RCRA regulatory and permit requirements; the EPA approved Puerto Rico Aqueduct and Sewer Authority (PRASA) CWA Pretreatment Authorized Program, specifically the PRASA Industrial Discharge Permit; and the Toxic Chemical Release Reporting Requirements, 40 C.F.R. Part 372.
