On September 1, 2015, EPA Region 8 filed a Combined Complaint and Consent Agreement (CCCA), which initiates and resolves claims under the Clean Water Act for alleged NPDES violations by Panther Development Investments (Panther) at the White Oaks Trailer Park and Black Eagle Estates construction sites located in Mandaree, North Dakota. EPA alleged in the CCCA that Panther did not obtain stormwater construction permits for the two projects mentioned above. These alleged violations were discovered during NPDES inspections conducted on August 28, 2014.
The White Oaks Trailer Park project consisted of grading and adding utilities for a new trailer park. There was evidence of discharge without a permit at the site as sediment accumulation, which appeared to be deposited by flowing water, was observed on the south side of the site. Stormwater from the site flows to Boggy Creek which flows to Lake Sakakawea. There were no structural best management practices (BMPs) at the site. At the time of the inspection, the site had not submitted a notice of intent (NOI) according to the EPA?s NOI website.
The Black Eagle Estates project consisted of grading, adding utilities and building residential homes. There were very limited BMPs at the site and the BMPs that were present were in need of maintenance. Stormwater from the site flows to Boggy Creek which flows to Lake Sakakawea. At the time of the inspection, the site had not submitted a NOI according to the EPA?s NOI website.
