On March 8, the DOJ filed on behalf of Region 3 and WVDEP a Complaint against LPG Land & Development Corp. in the U.S. District Court for the Northern District of West Virginia. The Complaint alleges that, in the course of constructing the Mon Fayette Industrial Park in Monongalia County, WV, LPG violated the CWA and state law by discharging dredged and/or fill material to Coles Run, a tributary of Cheat Lake, and its tributaries. The Complaint further alleges that LPG also discharged stormwater associated with construction activity without a permit and in violation of a permit issued by WVDEP and discharged stormwater polluted by chemicals used in operations at the Mon Fayette Industrial Park. The Complaint seeks a penalty and a court order for LPG to offset its impacts to Coles Run and come into compliance.
