REGION 3 ISSUES ?FIRST AMENDMENT [TO] SETTLEMENT AGREEMENT AND ADMINISTRATIVE ORDER ON CONSENT FOR SUPPLEMENTAL REMEDIAL INVESTIGATION AND FOCUSED FEASIBILITY STUDY? IN RE: BUCKINGHAM COUNTY LANDFILL SUPERFUND SITE, BUCKINGHAM COUNTY, VA.
On or about 12/30/15, EPA issued an Amendment revising the RI/FFS AOC with Univar USA, Inc. at the Buckingham County Landfill Superfund Site located in Buckingham County, VA. The AOC itself tasks Univar to, among other things, undertake certain groundwater investigations to determine the nature and extent of contamination at the Site. The financial assurance requirement section of the AOC erroneously stated that Univar was to maintain financial assurance in the amount of 1.5 million dollars, whereas the correct figure should have been $750,000. Therefore, the parties executed an amended AOC which cures the error by replacing the figure 1.5 million dollars with the corrected figure of $750,000.
