On October 6, 2015, Region 1 filed a Consent Agreement and Final Order that both initiated and resolved EPA?s claims for a civil penalty against P.R. Russell regarding alleged violations of Section 7(c)(1) of FIFRA, 7 U.S.C. ?? 136e(c)(1) for failing to submit timely annual pesticide reports for its Brentwood, New Hampshire facility for calendar years 2012 and 2014. Pursuant to EPA?s FIFRA Section 7 Expedited Settlement Agreement Pilot Program, the settlement calls for the payment of a $400 penalty. EPA requires that pesticide-producing establishments submit annual reports by March 1, covering production, sales and distribution of pesticides (and pesticidal devices) for the preceding calendar year. EPA uses the reports for compliance, risk assessment, and risk reduction activities important for protecting human health and the environment. Even those registered facilities that have not produced any pesticides or pesticidal devices in any given year must submit a report to EPA.
