## Summary

On December 9, 2015, Region 10 filed a consent agreement and final order resolving violations of the Clean Water Act by Alaska Petroleum Distributing Inc. located in Valdez, Alaska.  On December 9, 2014, one of the Respondent's tanker trucks was hauling low-sulfur diesel oil near Milepost 48 of the Richardson Highway when it slid off the road and spilled approximately 4,400 gallons of diesel fuel oil. The spill occurred approximately 48 miles northeast of Valdez, Alaska. The spill entered an unnamed creek and resulted in an emergency response action, removal of contaminated snow and soils, and stream restoration activities. The unnamed creek flows into the Tiekel River and then into the Copper River. The Tiekel River contains Coho Chinook salmon, an anadromous fish and the Copper River contains several anadromous fish species, including Coho, Chinook, Pink, and Sockeye salmon, Cutthroat Trout, Dolly Varden, Eulachon, and Steelhead Trout. The Respondent agreed to pay a penalty of $52,000.
