On November 12, 2015, Region 10 fully-executed a Consent Agreement and Final Order (CAFO) with the US Army Fort Wainwright (Fort Wainwright, Alaska) resolving violations of the Army's RCRA Permit. The RCRA Permit requires that Ft. Wainwright notify EPA in writing of any newly-identified, newly-discovered, or newly-created solid waste management units (SWMUs) within fifteen calendar days after discovery of the unit and requires them to submit a SWMU assessment report within 90 days of notifying the EPA of the notification of the SWMU. The Army did not notify of the EPA of the OB/OD River Site SWMU until approximately eleven months after the effective date of the Permit and about 16 months after the Army had knowledge of the SWMU. Pursuant to the terms of the CAFO, the Army must submit a completed SWMU assessment report no later than December 10, 2015. The Army has agreed to pay a penalty of $59,220 and to report any additional SWMUs that may be subject to the permit requirement within 15 days of the effective date of the CAFO.
