Summary

The Department of Justice lodged a Consent Decree on March 28, 2018, and the Consent Decree was entered May 15, 2018, with the Beaverhead [County] Jackson Sewer and/or Water District public water system in Beaverhead County, Montana for violations of certain National Primary Drinking Water Regulations (NPDWR). Violations at this system include exceeding the maximum contaminant levels (MCLs) for arsenic and for combined radium and also monitoring and reporting violations for arsenic, combined radium, gross alpha and the Consumer Confidence Report (CCR). Compliance requirements in the Consent Decree include: 1) upgrading the system by drilling three new water supply wells, testing each well for water quality, constructing a new well house complete with pumps, pressure tanks and controls, and installing curb stops; 2) avoiding MCL exceedances for arsenic, combined radium and gross alpha; 3) monitoring and reporting required by the NPDWR; 4) notifying the public of NPDWR violations; 5) distributing annual CCR to system customers and providing certification to the EPA and MDEQ; and 6) using services of a certified operator. Stipulated penalties are set forth for failure to comply with the requirements of the Consent Decree.
