On November 4, 2015, EPA Region III issued a Final Order to the Borough of Clarks Summit, resolving CWA violations of Pennsylvania's Municipal Separate Storm Sewer System (MS4) general permit for small MS4s. During a June 2014 EPA inspection of Clark Summit's MS4 program, EPA determined that the Borough was violating the Pennsylvania MS4 general permit by failing to maintain a written operations program for its municipal facilities, failing to track the operations of post construction stormwater management facilities within the Borough, and failing to develop a municipal employee stormwater training program. In the Consent agreement and Final Order (CAFO) which initiated and resolved this matter, Clarks Summit agreed to pay a $6,000 civil penalty for the MS4 permit violations. The CAFO received no comments during the required 40-day public comment period.
