Summary

On August 25, 2015-August 27, 2015, EPA conducted an Audit of the Town's Municipal Separate Storm Sewer System (MS4) program. During the Audit, EPA inspected the Town's highway facility, which is located in the Village of Hilton. Oil and water separator effluent and vehicle wash waters flow from the Town's highway garage to the Village of Hilton's MS4 and Salmon Creek, a tributary of Lake Ontario. In addition, evidence of sediment-laden discharges associated with outdoor rinsing of dump trucks was also identified at the highway facility. The Town does not have SPDES permit coverage for the aforementioned discharges. The purpose of this Information Request and Administrative Compliance Order is to require the Town to cease and desist unauthorized discharges to Salmon Creek and provide EPA with short and long-term remedies. Additional Clean Water Act (CWA) violations identified at the time of the Audit associated with the Town's failure to comply with terms and conditions of the NYSDEC MS4 General Permit will be addressed under a separate Administrative Order.
