Respondents own and operate a Concentrated Animal Feeding Operation (CAFO) located at 3409 State Highway 28 in Milford, NY. The facility failed to comply with the conditions of its NYSDEC SPDES General Permit for CAFOs, including failure to implement all CNMP practices by the Permit deadline and failure to prevent animals from coming into contact with surface water, as required by the Permit. Stormwater discharges from the facility discharge to a tributary to the Susquehanna River which is part of the Chesapeake Bay watershed. The agreed upon penalty is $5,500.
