The Respondent is a permitted MS4 in Newburgh, NY. An MS4 Audit was conducted on June 25, 2015 and identified that the Respondent was not complying with the terms and conditions of the NYSDEC MS4 General Permit. Violations include but are not limited to: inadequate Stormwater Management Program (SWMP) Plan; failure to fully implement the SWMP Plan; failure to fully develop and implement an illicit discharge, detection and elimination program (including failure to develop and maintain an outfall map and preliminary storm sewershed boundary map, failure to conduct a complete outfall reconnaissance inventory, failure to develop procedures to eliminate illicit connections, and failure to develop a program to inform public employees, businesses, and the general public of the hazards associated with illegal discharges and improper disposal of waste); failure to fully develop and implement a post-construction program (including development of a post-construction stormwater management practice inventory and ensure long-term operation and maintenance of management practices); failure to fully develop and implement a pollution prevention and good housekeeping program and complete self-assessments of municipal facilities as required. An Information Request and Administrative Compliance Order is being issued to order the Respondent to address the violations pursuant to the NYSDEC MS4 General Permit.
